2018 Dosen Deposition Summary and Breakdown

On Wednesday, February 14, 2018, a deposition was conducted with Anthony Dosen in regard to Case Number 17, TRT 0, 0, 0, 0, 1, 1E. Melanie Keener vs Gerald Antinoro, in which sexual harassment was alleged.


In this deposition, a foundation was laid alleging Mr. Dosen had first-hand knowledge of, and alleged participation in, sexual harassment with subordinates in the workplace at Storey County Sheriff’s Office, and also alleging there is a history that such misconduct was not reported. During this deposition, Anthony Dosen is sworn in and under oath, therefore all information that Mr. Dosen claims as first hand knowledge is as close to the truth as one could possibly get.


During the deposition, the attorney, Mr. Flangas, establishes Tony Dosen and Gerald Antinoro have known one another since 2006, when they were both deputies in Storey County, and are very good friends.


Mr. Dosen rose to the position of acting chief deputy within the Storey County Sheriff's office in 2016. The chief deputy position being held prior by Ms. Keener, Tony Dosen was asked by Attorney Flangas, if, in 2016, Dosen became aware of why Ms. Keener was no longer with the sheriff’s office.


Mr. Dosen replied that he believes she left due to an allegation of sexual harassment, and that he heard this from, in his words, quote, "everyone,” end quote, including Mr. Antinoro, and that Mr. Antinoro had a complaint filed against him.


Mr. Dosen was asked a variety of questions regarding inappropriate comments read directly from Ms. Keener’s complaint, which was filed in federal court, alleged to have been made to Ms. Keener while she and Mr. Antinoro were on duty driving to a chief’s and sheriff’s convention in Ely, Nevada.


The alleged comments included, among other things, Mr. Antinoro telling Ms. Keener he paid his ex-wife to have sex with other men while he watched; allegedly referencing his ex-wife being choked by a black male stating, quote: "choking her because his penis was so long it was choking her from below." End quote. And allegedly telling Ms. Keener about visiting a place called The Green Door in Las Vegas, Nevada, an infamous wife swapping club that is frequented by swingers.


Mr. Dosen was asked if he felt it was appropriate for a supervisor to tell these things to a subordinate. Mr. Dosen replied: quote,


“As a supervisor, probably not; as a friend, who’s to say,"


end quote. Attorney Flangas goes on to inform Mr. Dosen of more alleged inappropriate comments made to Ms. Keener by Mr. Antinoro, again reading from the filed complaint. Mr. Antinoro tells Ms. Keener about going to strip clubs with his ex-girlfriend, and watching as she allowed men to fondle her, have sex with her in the bathrooms, and more. Mr. Dosen was asked if these were appropriate comments from a supervisor to a subordinate, to which Mr. Dosen again replied,


“In the capacity of a supervisor to a subordinate, no.


Talking as a friend…” and he trails off.


The attorney then asks Mr. Dosen to assume Ms. Keener never welcomed nor solicited that kind of talk. Would it be appropriate to engage in that kind of talk to a subordinate. Mr. Dosen replies:


“If she had objected to those comments as a friend, no.”


The attorney asks Mr. Dosen if she must object before it becomes inappropriate. Mr. Dosen replies:


“Well, I’d say it would be incumbent upon her to state that she didn’t like that.”


The attorney then goes on to establish that as the chief deputy, one would be responsible for enforcing policies and procedures that affect the sheriff’s department. Mr. Dosen agrees.


The attorney then establishes with Mr. Dosen that the sheriff’s department has policy procedures that deals with anti-harassment, specifically prohibited conduct, behaviors, which include, but are not limited to offensive verbal communication including slurs, jokes, epithets, derogatory comments, degrading words or comments, unwanted sexual advances, invitations, or sexually degrading or suggestive words.


Mr. Dosen is then shown another page from the policy and procedures titled “Employee Responsibilities,” which states that an employee is not required to talk directly to the alleged harasser or to the employee’s supervisor. It is clear by the sheriff’s office policy; Ms. Keener had no obligation to tell the harasser to stop. This type of behavior should not occur in the workplace and the policy is in place to prevent that, and Mr. Dosen did have an obligation to intervene. It is established throughout the 124 -page deposition that Mr. Dosen had knowledge this prohibited behavior occurred in an ongoing basis, and that Mr. Dosen was party to much of it.


Next, the attorney establishes Mr. Dosen had an affair with a reserve deputy named Allison Morgan in 2013. At that time Mr. Dosen was a sergeant and Ms. Morgan was a reserve officer in the training program, which would make Ms. Morgan a subordinate. During this line of questioning, the attorney states that Ms. Morgan testified that she and Mr. Dosen engaged in sexual activity while on duty. Mr. Dosen denies that ever occurring on duty. However, in text messages between Mr. Dosen and Ms. Morgan, which were read into the record, she infers that the affair did occur on duty.


Ms. Morgan was laid off in 2013, and in the deposition it was insinuated that this was due to her refusal of advances by Mr. Antinaro. On page 86 within the deposition, Mr. Flangas asks Mr. Dosen as to the context of Ms. Morgan's text message where she says,


"He might have gotten jealous because I told him no and went ahead and had an affair with you."


On page 89 through 91, Mr. Flangas discusses Ms. Morgan's purpose of initiating a text conversation with Mr. Dosen. Within the time of these messages, Ms. Alison had been laid off and was once again reaching out to Mr. Dosen to inquire about a position within the department. Mr. Dosen allegedly uses his position of authority to demand sexual favors from Ms. Morgan in return for getting hired. An abridged version of the text conversation is as follows:


Allison Morgan initiated a text message with Anthony Dosen, stating:


"So I heard Storey County is hiring again."


Mr. Dosen:


Yup. You interested?


Allison Morgan:


"I thought about it again but I am not sure that I wouldn't be railroaded out of there by certain people again. LOL"


Mr. Dosen writes back:


I'm better than him. You married yet?


Allison Morgan replies:


"LOL. No, I'm not married and I'm not dating anybody still. I was seeing a guy for about a month and things didn't work out. Too many red flags for me although he was a sweetheart."


Mr. Dosen :


“Let me know when you want the freak.”


Ms. Morgan replies:


"Aren't you still with that girl in Fowlen? "Haw, haw, haw. Whatever."


Dosen responds by saying:


"I'm with everyone, a free cock spirit."


"LMFAO. Yeah, I remember that about you. So you guys have pretty much an open relationship? That should be an ideal situation for you."


Dosen replies:


"It is. She loves pussy as much as I do."


Allison responds:


"Last time I talked to you, you were asking me to teach her something. You must have done that."


Dosen replies:


"You still can. She will eat you until you scream."


Allison Morgan:


"I don't think you will ever get someone to do everything you want and what turns you on."


Anthony Dosen:


"She's my slave, does whatever she is told."


Allison Morgan:


"LOL. So you got her to agree to sign your sex slave contract? LMAO."


Allison Morgan later replies to Anthony Dosen's sexual advances by stating:


"Oh. LOL. Well if I consider going back to Storey County then that might cause issues again like it did last time. So I don't know if that would be such a good idea."'


Dosen replies:


“Not if we worked together before or after work.


LOL.”


Ms. Morgan replies:


“Oh, you mean not on shift this time?


LOL.”


Mr. Dosen writes back:


“I guess you’re so fucking hot I can’t control myself.”


The conversation then continues for several more pages of very sexually explicit text messages between the two parties.


Then on page 97 of the transcript, Ms. Morgan asks Mr. Dosen:


“So when will you be able to find out if they are taking laterals or I’ll have to do the physical test?”


Mr. Dosen replies:


“Next couple of days. What are you willing to do for the info? LMFAO.”


Ms. Morgan writes back:


“Ha, ha, ha.


Always dirty Tony.”


Later down page 98 of the transcript, Mr. Dosen continues texting:


“What are you saying?


Am I making your pussy wet?’


The sexually explicit texting continues until page 101 when Ms. Morgan again asks about the jail position.


“So how could I work in the jail if you only have cat threes in there?”


To which Mr. Dosen texts back:


“Tell me how wet your pussy is in detail and I will give you the info.”


Ms. Morgan replies:


“Nope. LOL.”


Mr. Dosen texts back:


“I know your pussy is gushing.”


Ms. Morgan tries to end the conversation by replying:


“LOL. Have a good day Tony.”


Mr. Dosen writes back:


“Just admit it.”


Ms. Morgan texts:


“Goodbye.”


The attorney again establishes with Mr. Dosen that there is an obligation for a supervisor to report any sexually harassing behaviors in the following testimony from pages, 106 to 107 of the transcript.


Mr Flangas asks: “If one of your sergeants was sexually harassing one of the deputies and you found out about it, would you discipline the sergeant, or would you just take the deputy and remove the deputy from the department?”


Mr. Dosen said,


“If the sergeant was the one committing the harassment, then obviously the sergeant would have to be dealt with.“


Mr Flangas assks: “You agree with me, then, in that juncture you shouldn’t punish the person who’s being harassed. Right?”


Mr. Dosen said,


“In that situation, yes,"


In questioning later during the deposition, the attorney asks Mr. Dosen about alleged encounters within the Storey County Sheriff’s Office with sex workers at the Mustang Ranch, asking if it would be proper for the sheriff of Storey County to date a sex worker from the Mustang Ranch. To which Mr. Dosen replies,


“I’m not the moral police. I can’t answer that.”
